BTA2023 Former Finance Minister, Ken Ofori-Atta, has filed a lawsuit against two National Security operatives for trespass and violation of his right to privacy following an alleged unauthorized raid on his Cantonments residence in Accra.
The lawsuit, filed at the Accra High Court on Monday, March 10, 2025, names DSP Bismark Boakye Ansah and Chief Inspector Mensah as defendants.
Details of the Alleged Raid
Mr. Ofori-Atta claims the incident occurred on February 11, 2025, when individuals believed to be National Security operatives conducted a search of his residence:
- The raid was unannounced and without legal justification.
- The operatives did not present a warrant or explain the basis for the search.
- His domestic staff were instructed not to use mobile phones during the operation.
Mr. Ofori-Atta stated that the raid caused his staff to experience severe trauma, while he himself has suffered anxiety, distress, and significant personal loss.
Relief Sought
In his statement, Mr. Ofori-Atta is asking the court to:
- Declare the search of his residence as trespass and a breach of privacy.
- Award damages for the trespass and violation of his rights.
- Issue a perpetual injunction preventing any future unauthorized searches by the defendants or their agents.
The case is expected to set a legal precedent on the boundaries of security operations and the protection of citizens’ privacy, especially for former public officials.
